How to participate and win

1. QUALIFICATIONS / DISQUALIFICATIONS OF PARTICIPANTS:
   • The Promotion (the “Promo”) is open to all individuals aged 18 years old and above, Filipino citizens or persons residing in the Philippines, who purchase the specially marked promotion packs, as defined below.

   • Employees of Nestlé Philippines Inc. (NPI) ,Globe Telecom Inc., Innove Communications Inc., and Adspark Inc. (referred to collectively as “Organizers of the Promotion”) and other official media partners and sponsors and their relatives up to the second degree of consanguinity and affinity are disqualified from joining this Promotion.
   • By joining and participating in the Promotion, those qualified and interested to join (the“Participant/s”) hereby confirm, agree and acknowledge that:
     1. He or she has read the full mechanics of this Promotion and agrees to abide by the terms and conditions of the same;
     2. Organizers of the Promotion have the right to identify him or her as a participant in the Promotion and communicate the same at any time, in any territory and through any medium of release (mass media, digital media, etc.)
     3. He or she shall hold organizers of the Promotion free and harmless from any and all claims, suits and actions for damages or liabilities that may be brought by other persons, natural or juridical, in connection with his/her participation in this Promotion as well as the statements and declarations made by participant in relation to the Promotion;
     4. He or she explicitly authorizes NPI, its principals, subsidiaries, affiliates and its agencies to use his/her image/s, image/s of his/her redemption pack/s and his/her personal information and/or registration data provided for purposes of running this Promotion and for any communications in digital media, any press release, or any other medium suitable for the promotion of NPI or any of its products, in accordance with its privacy policy which can be accessed through https://www.nestle.com.ph/info/Pages/PrivacyPolicy.aspx and in compliance with existing data privacy laws and regulations, including but not limited to the Data Privacy Act of 2012 and its Implementing Rules and Regulations;
     5. Organizers of the Promotion may, without further compensation to participant: (a) reproduce, distribute, adapt, modify, make available and/or communicate to the public, exhibit, or broadcast any material or information regarding this Promotion, including the Participant’s redemption pack, through any means or media without restriction of any kind as to quantity, purpose or time, whether commercial or otherwise, or to any country or territory in the world; and (b) authorize any of the above activities; and
     6. Organizers of the Promotion shall not be liable for any unauthorized use, reproduction and/or adaptations by third parties of any materials developed in the course of this Promotion including but not limited to advertising materials.

   • The Promotion Period is from August 15, 2021 – November 30, 2021 and redemption of prizes is until November 30, 2022.
2. DESCRIPTION OF PROCEDURES AND MECHANICS
   • Each specially marked BEAR BRAND® pack entitles the consumer to the following number of entries for each successful registration of the unique alphanumeric code found inside each pack:

   • This promotion is open to subscribers of Globe, TM, Smart, Talk n’ Text, and Sun.
   • To submit a raffle entry, the participant will need to perform the following steps:
     1. Buy specially marked promo packs.
     2. Find the unique alphanumeric code printed inside the pack.
     3. Once they retrieve the code they may either register and enter their code via SMS or via the BEAR BRAND® Powdered Milk Drink FB Messenger
        • VIA SMS:
          1. STEP 1 - REGISTER:

          5. Once Registered:
             1. If invalid age / location:
                1. Customer will receive an SMS that this campaign has an age restriction and user will not be registered
                2. Customer will receive an SMS to input the correct location
             2. If valid location / age:
                1. System will automatically add the mobile number and tag as registered
                2. Customer receives SMS confirmation that they have been registered
             3. If customer tries to register again:
                1. Customer receives an SMS saying they have already registered
          6. STEP 2 – Data Privacy Agreement
          7. Customer will be informed that we will need their personal information and will be asked if they agree to Nestle’s Privacy Notice on the use of their personal information
             1. If agree, customer will proceed to the next step
             2. If disagree, customer will be advised that agreement is necessary to participate in the promo
          8. STEP 3 – Promotional Message Opt-In
             1. After successful registration text message will ask for consent if consumer wants to receive BEAR BRAND promotional messages.
                1. User to reply “BEARBRAND<space>YES” if they would like to receive promotional messages
                2. User to reply “BEARBRAND<space>NO” if they don’t want to receive promotional messages
          9. STEP 4 – Submitting Entries
             1. Text “BEARBRAND<space>SUBMIT<space>CODE to 225656522
                1. This will be case-sensitive
             2. If submitted entry and already registered:
                1. Invalid code
                   1. Receives SMS that the code is invalid and to try again
                2. Valid code
                   1. Receives SMS confirmation that they are entitled to one raffle entry
             3. If submitted entry but not yet registered:
                1. Customer to receive an SMS that they should register first to participate in the campaign
          10. CHECKING ENTRIES
              1. Customer will type "BEARBRAND<space>ENTRIES then sends to 225656522
                 1. If already registered:
                    1. Customer receives an SMS showing the total number of entries
                 2. If not yet registered:
                    1. Customer receives SMS instructing them to register first to participate in the campaign

   • Weekly winners to be drawn, with a Grand Draw to be held at the end of the Promotion Period pursuant to the mechanics further detailed below.
     1. For the Weekly Draws
        1. A total of 8 Weekly Draws will happen every Monday from October 4 to November 22, 2021 and a Grand Draw will happen on Nov 30, 2021. If a draw date falls on a public holiday, it will be moved to the Wednesday of that week.

        2. Cut off of entries will be every Sunday at 11:59PM. Entries not submitted by the cutoff times will NOT be included in the pool for that week’s draw but will be included in the next weekly draw.
        3. Draw Procedure
           1. Zoom link will be sent to FDA for their participation
           2. AdSpark, Nestle, and FDA representatives will be present during the draw
           3. All raffle draw winners will be verified by FDA, AdSpark, and Nestle representative. The FDA, AdSpark, and Nestle Representative will sign on a document verifying the winners.
           4. Once complete, the standard raffle draw report will be shared to FDA and Nestle for reference.
           5. SMS notifications will be sent to all respective winners by AdSpark
        4. See Section III “Prizes at Stake” for details on the prizes for weekly and grand draws.
        5. Winners will be notified via their registered mobile number or registered Facebook messenger profile. Winners will also be announced on the BEAR BRAND Powdered Milk Drink Facebook Page.
        6. Upon Contacting of Winner, they will be requested to:
           1. Send screenshot of the congratulatory SMS sent by Adspark
           2. Send proof of winning code (clear photo of the front of pack, the printed code inside the pack, and the pack’s batch code)
           3. Send photo of Valid ID. The name on the ID should match the name of the registered winning entry.
        7. Winning codes from previous weekly draws will immediately be removed from future weekly draws, but will still be eligible for the grand draw.
        8. In weekly draws, each person may win up to 1 prize only and will be disqualified for another prize in the weekly draw.
        9. The winners will only have until November 30, 2022 to claim the prize/s they have won. After the claim period has lapsed without a claimant, the Food and Drug Administration (FDA) shall be immediately informed. Prizes may be forfeited in favor of the Organizers of the Promotion only upon written approval of the FDA.
        10. In any event that the submitted entries do not meet the number of allocated weekly winners, the remaining prizes allocated for that week will be forfeited in favor of the Organizers of the promotion only upon written approval of the FDA.
        11. Announcement of weekly winners and the winners of the Grand Draw shall be posted on the BEAR BRAND® Powdered Milk Drink Facebook page. See Section III “Prizes at Stake” for details.
        12. Each participant may contact Nestlé Consumer Hotline in the event of any concern on the activation of the unique codes inside the promotion packs by referring to the “Good To Talk” portion of the promotion pack:

        13. In this event, NPI reserves the right to ask for the original promotion pack and to disqualify the redemption pack/participating product that does not comply with the parameters as stipulated in these Promotion mechanics, as it deems fit and just and its decision on the matter is final. NPI reserves the right at all times to disqualify promotion packs which it has determined, in its sole discretion, to be inauthentic, perforated, damaged, and / or manipulated.
        14. A Participant represents and warrants that:
            1. He or she is solely responsible for his or her participating product/redemption pack.
            2. He or she either owns the participating product/redemption pack/s, or he or she has received the owner's permission to use the participating product/redemption pack/s and to activate the prize.
        15. By activating the prize/s, the Participant attests that he or she has read and understood the full Promotion mechanics and agrees to abide by the terms and conditions of the same.
        16. Redemption of prizes after the redemption period ending on November 29, 2022 (11:59 p.m.) is considered void and invalid.
3. Prizes at Stake
   1. Only the participants who send the unique alphanumeric codes printed inside the specially-marked promotion packs bearing the unique promotional violator, shall be entitled to join the raffle and get a chance to win the weekly prizes and grand prizes.

   3. In the event that the amount of purchased goods/services is more than the gift certificate / prize / points awarded, extra costs will be shouldered by the winner. In the event that the amount of the purchased goods/services is less than the gift certificate / prize / points awarded, the remaining balance shall be forfeited and no longer redeemable.
   4. The redemption of these prizes shall be subject to applicable governing laws, rules, and regulations, executive orders, memorandum circulars, memorandum orders and office orders, as may be amended from time to time; and shall further be implemented based on the existing merchant terms and conditions.
   5. With regard to the reliability of the quality and functionality of the prizes stipulated above, NPI relies on the representations from Globe Telecom, and each individual partner merchant, and Participant should direct his or her inquiries to Globe Telecom, for any redemption concerns under this Promotion, including but not limited to issues on the redemption of the prizes with the applicable partner merchant.    6. Notwithstanding the foregoing, in the event of any concern on the redemption of the unique codes inside the promotion packs, Participant may contact the Nestlé Consumer Hotline pursuant to the details stipulated above.
4. How to Claim Prizes
   1. For each of the prizes won for the Weekly Draws and Grand Draw, AdSpark will send a text message to the winner to inform him/her that he/she has won the prize and how to redeem the same within the Redemption Period.
   2. All rewards / prizes must be redeemed on or before November 30, 2022 11:59pm and the redemption of such rewards /prizes shall be subject strictly to applicable merchant terms and conditions.
   3. The claiming of prizes shall be subject to the following conditions: a. Possession of all the qualifications and none of the disqualifications set forth in these mechanics; and b. Compliance with all the terms and conditions set forth in these mechanics.
   4. All prizes earned under this Promotion are not transferable and not convertible to cash or other goods or services.
   5. Organizers of the Promotion will assume all applicable taxes on the prizes.
5. Other Guidelines:
   1. Organizers of the Promotions to assume no responsibility for:
      1. Any incorrect, inaccurate or incomplete information resulting from or caused by any of the equipment or programming associated with or utilized in the conduct of the Promotion.
      2. Any technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, and other problems or technical malfunctions in the conduct of this Promotion.
      3. Any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of submissions of the Participants under this Promotion or other similar instances that may occur in connection with or in relation to this Promotion.
   2. NPI, its parents, affiliates, subsidiaries and related companies or its officers, directors, employees, shareholders, representatives or agents shall not be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any access to and use of the digital properties of NPI and Globe Telecom Inc. / Innove Communications Inc. without limiting the generality of the foregoing, the prizes activated under this Promotion are provided without warranty of any kind, either express or implied , including but not limited to , the implied warranties of merchant ability , fitness for purpose or use or non-infringement.
   3. NPI, its parents, affiliates, subsidiaries and related companies or its officers, directors, employees, shareholders, representatives or agents shall not be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any access to and use of the digital properties of NPI and Globe Telecom Inc. / Innove Communications Inc. without limiting the generality of the foregoing, the prizes activated under this Promotion are provided without warranty of any kind, either express or implied , including but not limited to , the implied warranties of merchant ability , fitness for purpose or use or non-infringement.
The decision of the Organizers of the Promotion to cancel, discontinue or suspend this Promotion on the basis of the foregoing is final and they will not engage in any dialogue with any person regarding such decision.
